Terms of Service

These Terms of Service govern your use of Pickerway, available at pickerway.com.
Pickerway is a project owned and operated by Jove Software. By creating an account, starting a subscription, renewing a subscription, accessing paid features, or running a draw through the Service, you agree to be bound by these Terms of Service.
If you do not agree to these terms, please do not use Pickerway.
The Service
Pickerway is a provably fair giveaway picker.
You can use Pickerway to submit a public social media post from platforms such as Instagram, YouTube, TikTok, and others. Pickerway helps you select a winner from available comments, likes, or other supported public engagement data by using a cryptographically secure random number generator.
Every completed draw may produce a SHA-256 hash or similar verification record that can be used to help verify the result.
Pickerway is not affiliated with, endorsed by, sponsored by, or officially connected to Instagram, YouTube, TikTok, Meta, Google, ByteDance, or any other social media platform.
We use public data, supported access methods, platform APIs, or other available technical methods to provide the Service. Platform access may change at any time, and this may affect the availability or accuracy of certain features.
Eligibility
You must be at least 13 years old to use Pickerway.
If you live in a country or region with a higher digital age of consent, that higher age requirement applies to you.
By creating an account or using the Service, you represent that you meet the applicable age requirement.
You are responsible for making sure that your use of Pickerway is lawful in your country, region, and business context.
Your Account
You are responsible for keeping your account credentials safe.
Pickerway may support passkeys, password sign in, Google sign in, or other authentication methods. If you lose access to your sign in method, we may not always be able to recover your account.
You agree not to share your account with others.
You agree to notify us if you believe your account has been compromised or used without authorization.
You are responsible for all activity that takes place through your account, including draws, subscription usage, billing activity, and actions taken by anyone who accesses your account.
Subscription Plans
Pickerway provides access to its platform through paid subscription plans.
Pickerway does not sell standalone token packages. Any tokens, credits, draw allowances, usage rights, account benefits, or similar features are provided as part of an active subscription plan.
Subscription plans may include access to giveaway draw tools, platform features, recurring usage allowances, account benefits, usage limits, or other digital services described at the time of purchase.
Plan features, prices, usage limits, renewal periods, and included benefits may vary depending on the subscription plan selected.
We may change our subscription plans, pricing, limits, or included features from time to time. Any changes will apply according to the terms shown at checkout, inside your account, or in notices provided by Pickerway where appropriate.
Billing and Renewals
Subscription fees are charged in advance for each billing period.
Payments are processed by Stripe or another payment provider we may use from time to time.
By starting a subscription, you authorize Pickerway and its payment provider to charge the applicable subscription fee, taxes, and related charges for the selected billing period.
Unless canceled before the renewal date, your subscription may renew automatically according to the billing cycle selected at checkout.
You are responsible for reviewing your subscription status, renewal date, billing cycle, price, and cancellation options from your account or billing page.
Failure to use the Service, failure to log in, forgetting to cancel, or no longer needing the Service does not cancel your subscription and does not automatically entitle you to a refund.
Subscription Usage
A subscription is considered used if any paid feature, giveaway draw, token, credit, draw allowance, usage right, account benefit, or other subscription benefit has been accessed, spent, activated, or used during the billing period.
Subscription usage may include, but is not limited to:
Running or attempting to run a giveaway draw
Using a token, credit, draw allowance, or usage right included in the subscription
Accessing paid platform features
Using account benefits included in the subscription
Completing any paid action inside Pickerway
Generating, recording, resolving, or verifying a giveaway result
Once a subscription has been used during a billing period, the payment for that billing period becomes non-refundable, unless required by applicable law.
This applies even if only part of the subscription benefits were used.
Cancellation
You may cancel your subscription from your account or billing page where this option is available.
If you cannot access your account or billing page, you may contact us at:
To avoid future charges, cancellation requests must be made before the next renewal date.
We cannot guarantee cancellation before the next charge if your request is submitted too close to the renewal time or after the renewal payment has already been processed.
Canceling a subscription stops future renewals. It does not automatically refund previous charges, renewal payments, or the current billing period.
Unless otherwise stated inside your account, cancellation takes effect at the end of the current billing period, and you may continue to access paid features until that period ends.
Refunds
Refunds are governed by our Refund Policy.
Because Pickerway provides digital subscription access and digital services, refunds are limited.
You may request a refund for a subscription payment within 7 days of the original subscription purchase only if the subscription has not been used.
If the subscription has been used in any way during the billing period, Pickerway does not provide full refunds, partial refunds, or pro-rata refunds for that billing period, unless required by applicable law.
Pickerway does not provide retroactive refunds for previous billing periods, previous renewals, unused subscription time, unused features, unused credits, unused draw allowances, or subscriptions that were forgotten and not canceled before renewal.
A refund request does not guarantee approval.

You may be asked to provide your account email, transaction date, purchase amount, reason for the request, invoice, receipt, draw ID, or payment reference.
Service Failures
If a giveaway draw fails because of a technical error on Pickerway’s side, Pickerway may review the issue and restore the related usage right, credit, token, draw allowance, or subscription benefit to your account where appropriate.
Examples of service failures may include:
A draw could not be completed due to a Pickerway system error
A technical issue prevented winner selection from being completed
A completed result was not generated due to a platform side failure
This does not include failures caused by incorrect user input, unavailable third party data, deleted social media content, private accounts, restricted access, expired links, platform changes, or any issue outside Pickerway’s reasonable control.
In most cases, service failures are resolved by restoring the related platform benefit rather than issuing a cash refund.
Acceptable Use
While using Pickerway, you agree not to:
Attempt to bypass subscription limits, usage limits, rate limits, security measures, or pricing systems
Scrape, copy, resell, or redistribute data from Pickerway beyond what the Service itself provides to you
Use the Service to run a giveaway that is unlawful where it is being offered
Use the Service to run sweepstakes, contests, lotteries, or promotions that require payment for entry where such mechanics are prohibited
Use the Service to collect, process, or distribute personal data in ways that violate applicable law or the platform of origin’s terms
Harass, impersonate, mislead, or deceive other users
Use Pickerway for fraud, abuse, unauthorized access, payment misuse, or suspicious activity
Interfere with the normal operation, security, or integrity of the Service
You remain responsible for your giveaway’s compliance with local laws, social media platform rules, advertising rules, promotion rules, tax obligations, and prize obligations.
Giveaway Organizer Responsibilities
Pickerway is a software tool.
You are the organizer of any giveaway, contest, sweepstakes, campaign, or promotion you run through the Service.
You remain solely responsible for:
Complying with applicable sweepstakes, contest, lottery, advertising, consumer protection, data protection, and tax laws
Publishing clear rules and eligibility requirements to your audience
Obtaining any required permissions, approvals, or consents
Making any required legal disclosures
Awarding the prize you promised
Handling participant questions, complaints, claims, and disputes
Handling tax reporting or prize related obligations
Complying with the rules of the social media platform where the giveaway is hosted
Pickerway does not sponsor, administer, endorse, or take responsibility for your giveaway unless we expressly state otherwise in writing.
Platform Data and Third Party Services
Pickerway may depend on public data, third party APIs, platform access, social media availability, payment providers, hosting providers, analytics tools, and other third party services.
We do not control these third party services.
Social media platforms may change their APIs, access rules, rate limits, privacy settings, data availability, or technical behavior at any time.
These changes may affect Pickerway’s ability to fetch comments, likes, engagement data, or other information needed for a draw.
Pickerway is not responsible for failures, delays, missing data, inaccurate data, or unavailable features caused by third party platforms or services outside our reasonable control.
Intellectual Property
Pickerway, including its software, design, logos, documentation, content, systems, workflows, and technology, is owned by Jove Software or its licensors.
You may not copy, modify, reverse engineer, reproduce, resell, redistribute, or create derivative works from the Service without our written permission, except as expressly allowed by these terms.
The content you submit to the Service, such as post URLs, filter settings, account information, or your own communications, remains yours.
By submitting content to Pickerway, you grant us a non-exclusive, worldwide license to process, store, display, and use that content only as needed to provide, maintain, secure, improve, and support the Service.
Service Availability
We work to keep Pickerway available, secure, and accurate.
However, the Service is provided on an as is and as available basis.
We do not guarantee uninterrupted availability, error free operation, specific draw outcomes, permanent access to platform data, or that a specific social media platform’s data will remain accessible.
Platform APIs, public data access, and third party systems can change without notice and may affect draws that depend on them.
We may suspend, limit, or modify the Service where needed for maintenance, security, legal compliance, abuse prevention, or operational reasons.
Nature of Service and Disclaimer of Gambling
Pickerway is a Software as a Service utility tool.
We provide a technical system that helps content creators, brands, agencies, and organizers select giveaway winners from supported social media engagement data in a practical, fair, and verifiable way.
Please carefully note the following:
Pickerway is not a gambling or betting platform
Pickerway does not host, operate, or administer games of chance, betting services, gambling services, or paid entry lotteries
Pickerway does not provide, sponsor, endorse, or fulfill prizes
Prizes are solely offered and fulfilled by the giveaway organizer
Pickerway does not charge followers, participants, or end users to enter a giveaway
Subscription fees are paid by organizers for access to software tools and platform functionality
Giveaways run using Pickerway are not affiliated with Pickerway unless expressly stated in writing
You are responsible for ensuring that your giveaway is legal in the location where it is offered and where participants are located.
Suspension and Termination
You may stop using Pickerway at any time.
You may delete your account from the dashboard where this option is available.
We may suspend, restrict, or terminate your account if we reasonably believe that you have:
Violated these Terms of Service
Violated our Refund Policy or Privacy Policy
Used the Service for fraud, abuse, or unlawful activity
Misused payments, subscriptions, refunds, or chargebacks
Attempted to bypass subscription limits, security systems, or usage limits
Created risk for Pickerway, other users, payment providers, social media platforms, or third parties
If your account is suspended or terminated due to violation of these terms, fraud, abuse, payment misuse, or chargeback misuse, your remaining subscription benefits, credits, tokens, draw allowances, or usage rights may be forfeited unless applicable law requires otherwise.
Termination does not automatically entitle you to a refund.
Chargebacks and Payment Disputes
If you do not recognize a charge or believe there is a problem with your payment, please contact us first.
If you file a chargeback or payment dispute with your bank, card issuer, or payment provider, we may temporarily suspend access to paid features while the dispute is reviewed.
When responding to a payment dispute, we may provide Stripe, payment networks, banks, card issuers, or other relevant parties with evidence related to the transaction.
This may include account records, payment records, subscription status, renewal information, usage logs, draw records, refund request history, support messages, login records, and technical records related to completed draws.
We do this to prevent fraud, protect the integrity of the Service, and respond to payment claims accurately.
Limitation of Liability
To the fullest extent permitted by law, Jove Software, operating as Pickerway, and its affiliates, officers, employees, contractors, and service providers are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Service.
This includes, without limitation, loss of profits, loss of business, loss of goodwill, loss of data, giveaway disputes, prize disputes, platform access issues, third party platform changes, or claims from giveaway participants.
To the fullest extent permitted by law, our aggregate liability for any claim is limited to the amount you paid to Pickerway for your subscription in the twelve months preceding the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
Indemnification
You agree to defend, indemnify, and hold harmless Jove Software, Pickerway, and their affiliates, officers, employees, contractors, and service providers from any claims, damages, losses, liabilities, costs, and expenses arising from:
Your use of the Service
Your giveaway, campaign, contest, sweepstakes, or promotion
Your violation of these Terms of Service
Your violation of applicable law or platform rules
Your prize fulfillment, tax obligations, or participant disputes
Your misuse of subscription features, payment systems, or account access
Changes to These Terms
We may update these Terms of Service from time to time.
When we make a material change, we will update the Last updated date above and, where appropriate, provide notice through the website, app, account dashboard, or email.
Continuing to use the Service after a change means you accept the updated terms.
The version of these Terms of Service in effect at the time of your subscription purchase will generally apply to that purchase, unless a later version provides you with more favorable terms or is required by law.
Governing Law
These terms are governed by the laws of the Republic of Türkiye, without regard to its conflict of laws rules.
Any dispute arising from these terms or your use of the Service will be resolved in the courts of Istanbul, Türkiye, unless applicable consumer protection law gives you the right to bring proceedings elsewhere.
